Major Road Construction Project for Trafalgar Road and How It May Affect You

The Regional Municipality of Halton will be commencing construction in 2019 to widen Trafalgar Road between Leighland Avenue (Iroquois Shore Road) and Highway 407. This project will result in the widening of Trafalgar road from four lanes to six lanes, and will also see the installation of off-road cycling lanes. Infrastructure will also be improved along this corridor as well, including the replacement of existing acoustic walls and watermains.
To facilitate this major project, the Region of Halton is currently engaged in the process of acquiring interest in certain lands from property owners along this stretch of Trafalgar Road. Many property owners have been approached by representatives from the Region over the last few months with offers of compensation in exchange for partial land acquisitions and temporary or permanent easements.
A voluntary purchase from property owners is often the first step taken by a public authority, such as the Region of Halton, in securing the required land. If an amicable purchase and sale cannot be achieved, the next step is often the expropriation of land (to acquire land without the consent of the owner). Under the Expropriations Act, public authorities generally have the power to expropriate the lands in which it requires. More information on expropriations can be found here.
While the Region is currently not engaged in expropriation proceedings along Trafalgar Road, it is important to know what your legal rights are even at this stage, as it will form the basis of any agreement for compensation.
