Appellate Advocacy

Appellate advocacy differs significantly from trial advocacy as the law, goals, the issues, and process are quite different. Appealing a decision, or responding to an appeal, uses a distinct set of reasoning and skills.  It is a complicated mix of research, writing and oral advocacy, starting with the proper justification to bring the appeal, and the legal work of breaking down the decision appealed from.  Arguing an appeal is not simply a task of relitigating the decision below, appeals are heard under very different set of rules, and knowing them, and the way to adhere to them, is invaluable to our clients. OMH counsel have successfully brought and resisted appeals at appellate court levels, including the Divisional  Court, the Federal Court, and the Court of Appeal.
